Terms of service

Welcome to Potties. These Terms of Service ("Terms") govern your use of pottiespots.co.za (the "Site") and every purchase you make from us. By using the Site or placing an order, you agree to these Terms.

1. WHO WE ARE

Potties sells Hand-Cast aluminium cookware and related accessories, made in South Africa. We are based in Stellenbosch, Western Cape, South Africa. You can reach us at potties@pottiespots.co.za or on WhatsApp at +27 63 610 2989.

2. ORDERS

- An order is an offer to purchase. It is accepted when we send you an order confirmation.
- Every pot is Hand-Cast to order. Please allow 5-10 business days at the foundry before your order ships (a little longer for personalised pieces).
- We may decline or cancel an order where stock, pricing or payment problems arise; if we do, you will be refunded in full.

3. PRICES AND PAYMENT

- All prices are in South African Rand (ZAR) and include VAT where applicable.
- Cookware is sold as a set with its fitted canvas cover unless you remove the cover at the time of ordering; the displayed price reflects the set.
- Payment is processed securely at checkout through our payment providers. We do not store your card details.
- Obvious pricing errors may be corrected; if an order was placed at a clearly erroneous price, we will contact you before proceeding.

4. PERSONALISED CASTING AND CORPORATE BRANDING

- Custom-cast wording is charged per word at the rate shown at the time of ordering and is cast into the lid exactly as you submit it. You are responsible for spelling, punctuation and wording.
- Personalised and corporate-branded items are made to your specification and cannot be returned for change of mind (see our Return and Refund Policy).
- For corporate orders, you warrant that you hold the rights to any name, logo or artwork you supply, and you indemnify us against any claim arising from its use.

5. LIFETIME WARRANTY

Every Potties Hand-Cast aluminium pot, pan and lid carries a Lifetime Warranty against manufacturing and casting defects. If a defect appears, contact us and return the product; upon inspection of the returned product we will review the claim and, where the defect is ours, repair or replace the item. The warranty covers the casting itself and does not cover normal wear, misuse, modification, or accessories. Full details are in our Return and Refund Policy. This warranty is in addition to, and does not limit, your rights under the Consumer Protection Act.

6. DELIVERY

Delivery takes place as set out in our Shipping Policy. Risk in the goods passes to you on delivery; ownership passes on full payment.

7. PRODUCT INFORMATION

We take care to describe and photograph every product accurately. Because each piece is Hand-Cast and hand-finished, small variations in surface texture and finish are natural and are part of the product's character, not defects. Weights and capacities are approximate.

8. USE OF THE SITE

You agree not to misuse the Site, interfere with its operation, or use content from it (text, photographs, designs, logos) without our written permission. All content on the Site is our property or used with permission and is protected by copyright and trademark law.

9. LIABILITY

- Nothing in these Terms limits or excludes any right you have under the Consumer Protection Act 68 of 2008 or other applicable law.
- To the extent permitted by law, we are not liable for indirect or consequential loss, or for damage caused by misuse of a product, failure to follow care instructions, or unauthorised modification.
- Cookware gets hot. Always use appropriate protection (such as a vatlappie) and keep hot cookware away from children.

10. PRIVACY

We process your personal information in accordance with our Privacy Policy and the Protection of Personal Information Act 4 of 2013 (POPIA).

11. GENERAL

- These Terms are governed by the laws of the Republic of South Africa.
- If any provision of these Terms is unenforceable, the rest remain in force.
- We may update these Terms from time to time; the version published on the Site at the time of your order applies to that order.
